Introduction to the legal systems of the Jewish and Islamic traditions – comparison, specifics, and cultural-legal contexts of two important religious laws.
In the course, the student will acquire basic knowledge and skills in the field of legal systems of two major monotheistic religions. In the course, you will become familiar with the history, sources of law, methods, and content of Jewish and Islamic law, which have influenced not only the religious, but also the political and cultural development of many nations and civilizations. We will focus on how Jewish and Islamic law approaches various legal and social issues, such as dietary law (food and drink rules, ritual slaughter). You will become familiar with the sources and jurisprudence of both religious systems, we will focus on some aspects of community and everyday life, and then we will focus primarily on family law, as one of the most important areas of law for every believer. We will learn about the rules for marriage and divorce, relationships between spouses, and childcare. Last but not least, we will also focus on the basic rules of inheritance law.
To equip students with basic knowledge of selected areas of Jewish and Islamic law.
The excursion itself is divided into two parts. In the first part, the student will first become acquainted not only with the characteristic features of Jewish law and its sources, but also with how it differs from our current law. In the following lectures, he/she will be introduced to the law of personal status, dietary law (kashrut), and the Bej Din as an arbitration institution.
In the second part, the student will acquire knowledge of the field of Islamic law. He/she will become acquainted with its characteristics, sources, genesis, and legal schools. Then, the subject of interest will be what is permitted and prohibited in Islamic law, and the law of personal status.
The subject does not define any entry requirements.
After completing the course, students demonstrate basic knowledge of selected areas of Jewish and Islamic law. They are familiar with the basic characteristics of Jewish law, its origin and historical development, including an overview of ancient legal schools. They are also able to describe the characteristics and specifics of Islamic law, and compare its differences from other legal systems.
