Understanding the basics of Islamic law and its role in contemporary legal systems – from historical sources to modern constitutions.
The course focuses on both “classical” Islamic law and the law in force in Muslim countries. You will first become familiar with the history, sources of Islamic law, or rather its sources and schools of law, as well as the basic principles of Islamic jurisprudence. Within the course, we will focus on how Islamic law influences the legal systems of Muslim countries, and in which areas of state law it still plays a major role. For this reason, we will focus more closely on family and inheritance law, as well as criminal law, and other related legal areas. Within the framework of matrimonial law, we will deal with the rules of marriage according to both “classical” Islamic law and existing legal codifications. The same will apply to relations between spouses, property arrangements between them, divorces, and legal issues that are resolved in connection with divorce. In addition, we will focus on inheritance law, which is the most resistant to modernization trends, and criminal law, where we will examine various aspects of criminal law, with an overlap with family law.
To equip students with the necessary knowledge of the basics of Islamic law. This is an introduction to the subject, in which students will be familiar with the emergence and development of Islamic law, its sources, and subsequently with some of its legal branches.
